Construction & Fabrication Warranty Clauses
Construction Warranty Clause:
The Contractor warrants that all work performed under this contract shall be free from defects in materials and workmanship for a period of 30 days to 24 months depending on the type of item/s and incident that occurred from the date of substantial completion. In the event of any defects discovered during this warranty period, the Contractor shall promptly repair or replace, at no additional cost to the Owner, any defective work or materials.
This warranty shall not cover defects or damages resulting from:
Normal wear and tear.
Improper maintenance or misuse by the Owner.
Acts of God or natural disasters.
The Contractor's liability under this warranty shall be limited to the cost of repairing or replacing the defective work or materials. This warranty is in addition to any other warranties, express or implied, provided by law.
Fabrication Warranty Clause:
The Fabricator warrants that all fabricated products delivered under this contract shall be free from defects in materials and workmanship for a period of 30 days to 12 months depending on the type of item/s and incident that occurred from the date of delivery. In the event of any defects discovered during this warranty period, the Fabricator shall promptly repair or replace, at no additional cost to the Purchaser, any defective products.
This warranty shall not cover defects or damages resulting from:
Improper handling, storage, or installation by the Purchaser.
Misuse or unauthorized modifications.
Normal wear and tear.
The Fabricator's liability under this warranty shall be limited to the cost of repairing or replacing the defective products. This warranty is non-transferable and is limited to the original Purchaser.
